Terms & Conditions

Below are the general conditions for all courses of the Dutch Acupuncture Academy. With Chamber of Commerce number: 78177685, filed on July 9, 2021, as described here.

Article 1 – Definitions

Registration: A registration submitted by the student and recommended by the Dutch Acupuncture Academy for participation in a course involving an agreement between the student and the Dutch Acupuncture Academy.
Application date: The date on which the student has registered for a study program.
Start date: The date on which the training started.
Duration of study: The duration of the program as stated in the program information.
Program information: Information about the program as published on www.daa.academy and / or stated in the study guide.
Student: Natural person who takes one or more courses at the Dutch Acupuncture Academy.
Dutch Acupuncture Academy: Dutch Acupuncture Academy. Chamber of Commerce number: 78177685
Training material: Learning material, materials and related articles for (following) training.
Training: A training, course, further training, internal internship or study trip provided by the Dutch Acupuncture Academy.

Article 2 – Offer

  1. The offer contains a complete and specified description of the training and / or of the training material that is part of the training.
  2. The offer must in any case state the following information in a clear and comprehensible manner:
  3. When the training starts;
  4. The admission requirements to participate in the training;
  5. The price with dimensions of all additional costs;
  6. The method of payment.
  7. These general terms and conditions are expressly announced to the student and an integral part of the general information provision of the Dutch Acupuncture Academy prior to the agreement between the Dutch Acupuncture Academy. The general terms and conditions are fully applicable to all agreements that the Dutch Acupuncture Academy enters into with the student.

Article 3 – Agreement

  1. By registering for the program, the student enters into an agreement for the study hour with the Dutch Acupuncture Academy and the student agrees to the general terms and conditions as stated here.
  2. If specific conditions still apply to the chosen study program, these will be stated in the study program information.
  3. The agreement is concluded as soon as acceptance of the offer by the student has reached the Dutch Acupuncture Academy and the Dutch Acupuncture Academy has confirmed its receipt. Confirmation takes place after registration by e-mail and possibly by post.
  4. When registering, the student commits to the Dutch Acupuncture Academy for the duration of the entire program and the Dutch Acupuncture Academy expects the student to participate in the program with full commitment. In this way, the Dutch Acupuncture Academy can ensure proper planning and scheduling of teachers. On the other hand, the Dutch Acupuncture Academy offers high-quality training by qualified teachers. The Dutch Acupuncture Academy will indicate what is expected of the student, and the Dutch Acupuncture Academy will do its utmost to ensure that the student successfully completes the course.

Article 4 – Price

  1. The costs of the training, the method of payment, any number of payment terms, registration fees, examination fees and other additional costs are stated in the training information.
  2. All courses offered by the Dutch Acupuncture Academy are still exempt from VAT.

Article 5 – Payment

  1. The Dutch Acupuncture Academy is entitled to be informed by third parties about the creditworthiness of a student who has registered for the program. This may affect the payment terms offered.
  2. The student is in default by operation of law without additional notice of default being required from the date on which the mandatory payment term has expired and the fee owed has not been paid in full. The Dutch Acupuncture Academy then sends the student a payment reminder, so that the student can still pay within the stated term. If the student has not paid the full fee due in this period either, the Dutch Acupuncture Academy can charge the student a reminder fee of € 15.
  3. Any extrajudicial or judicial collection costs will be borne by the student.
  4. Private customers all remain responsible for the obligations arising from the agreement with the Dutch Acupuncture Academy. Even when the payment has been or is being transferred to a third party, such as an employer.

 Article 6 – Right of withdrawal

  1. A student may terminate the agreement free of charge and without giving reasons within 14 calendar days after the registration date (right of withdrawal).
  2. The provisions of Paragraph 1 do not apply if the cancellation date is after the start date of the course. The cancellation then falls under Article 9 (cancellation by the student)
  3. The student makes use of the right of withdrawal by sending an unambiguous statement by post or e-mail within this period that the agreement must be dissolved.
  4. After receipt of a request for dissolution by the Dutch Acupuncture Academy, the student has 14 days to return any items received, including training material, with sufficient postage. Dutch Acupuncture Academy will reimburse any tuition fees paid as soon as possible, no later than 14 days after the termination of the agreement or after the return of sent training material.
  5. Returns are only accepted if the items are in their original condition. That is, undamaged and unwritten, complete, only treated if it is reasonably necessary for viewing and in the original packaging. If these conditions are not met, the Dutch Acupuncture Academy will not accept the return and the student is obliged to take the course or to reimburse an impairment to be determined by the Dutch Acupuncture Academy.

Article 7 – Consequences of non-fulfilment of obligations

  1. If the student does not (fully) fulfil one or more obligations from the agreement or the general terms and conditions, Dutch Acupuncture Academy is entitled to suspend its obligations and interrupt or eventually terminate the program.
  2. The consequences of interrupting the program as referred to in paragraph 1 are for the account and risk of the student. These consequences include:
    1. Access to the digital learning environment will be denied, training material or updates will no longer be made available, teacher supervision will be discontinued and no exams can be taken.
    2. The study is delayed, as a result of which the study program may no longer (fully) follow the exam or an exam can no longer be taken and the study program cannot be completed with a diploma.
  3. On termination of the study program as referred to in paragraph 1, the following applies:
    1. Unless otherwise agreed in writing, the Dutch Acupuncture Academy no longer has any obligations to the student.
    2. If termination of the study program as referred to in paragraph 1 is premature, the conditions of article 9 apply.
    3. The completed training cannot be resumed. A student who wants to continue the course will have to enrol again.
  4. Being in default by the student does not mean that the agreement between the student and the Dutch Acupuncture Academy has ended.

Article 8 – Exams

If the student’s program has exams and / or tests, the following conditions apply:

  1. To be allowed to participate in the exam, students must register in good time and pay the examination fees due. The level of the examination fee is stated on studbord.nl (the digital learning environment of the Dutch Acupuncture Academy)
  2. Admission requirements apply to a number of exams. These are stated in the study information and / or on studbord.nl of the relevant study program.

Article 9 – Cancellation by the student

  1. After the right of withdrawal has expired (see art. 6) or after the start date, the student can cancel the enrollment with the following consequences:
    1. Up to two months before the start: 10%
    2. Between two months and two weeks before the start: 25%
    3. Less than two weeks before the start: 50%
    4. On or after the day of commencement: 100%
  2. In case of cancellation before the planned commencement date, the student has the right to have another student take part in the study program free of charge, provided that they meet the admission requirements of the study program. This is no longer possible after the start of the course.
  3. The provisions of Paragraph 2 do not apply to internship days, exams and refresher courses.
  4. In case of cancellation, the following matters also apply:
    1. Any cancellation costs must be paid in one go.
    2. Any training material received by the student must be returned in full.
    3. Any overpaid amount by the student will automatically be refunded to the student’s account within 14 days.

Article 10 – Implementation of education

  1. The Dutch Acupuncture Academy has the right to change the layout of the study program in terms of place and time. The Dutch Acupuncture Academy may also deviate from the starting date indicated in the training information for technical reasons. In some cases, the Dutch Acupuncture Academy can reduce the number of meetings per subject or adjust the intended group size.
  2. In the event of insufficient registrations, less than 5 students, the Dutch Acupuncture Academy reserves the right to cancel a start date for a specific location or to no longer accept new registrations. Students receive a timely notification of this, after which their obligations lapse and a solution is sought.
  3. When registering, the student must indicate a choice of location. Dutch Acupuncture Academy endeavours to organize meetings at that location.
  4. In the event of illness and / or a teacher being unable to attend, the Dutch Acupuncture Academy will make every effort to ensure an equivalent replacement. If replacement is not possible, the Dutch Acupuncture Academy will notify students as soon as possible. The meeting will then be rescheduled if possible. Failure of a teacher or meeting does not entitle you to compensation or refund of tuition fees and does not entitle you to catch up with the meeting.
  5. Lesson days are scheduled for the entire course. Missing class days and catching up later is in principle not possible. However, a request may be made to retake one or more days of classes for an appropriate fee. It is up to the Dutch Acupuncture Academy to assess whether this is possible.

Article 11 – Intellectual property rights

  1. The intellectual property rights to study material produced by the Dutch Acupuncture Academy remain, regardless of the form in which it is supplied (in print, digital or otherwise) at the Dutch Acupuncture Academy.
  2. Use of study materials and access to the digital learning environment studbord.nl other than for your own study is not permitted, nor is it the sale or transfer thereof to third parties.

Article 12 – Liability

  1. The liability of the Dutch Acupuncture Academy is limited to a maximum of the tuition fees paid by the student.
  2. Dutch Acupuncture Academy reserves the right to refuse, suspend and / or remove the student in special circumstances. Students who do not behave according to the social norm, show aggressive or violent behavior or commit fraudulent activities may be suspended from the program.
  3. All training material of the Dutch Acupuncture Academy, the brochures or other work, resulting from or related to the training, has been carefully developed and / or compiled by the Dutch Acupuncture Academy. However, Dutch Acupuncture Academy is in no way liable for damage, of whatever nature, that is the result of (possible) incorrect information in the training material, study guide or any other work arising from or related to the training, unless it concerns is intentional or deliberate recklessness on the part of the Dutch Acupuncture Academy.

 Article 13 – Privacy / Personal Data Protection Act

  1. The information provided by the student is included in the computerized administration of the Dutch Acupuncture Academy. This data is processed internally and used for responsible customer management and responsible business operations, such as registering students and sending training materials and sending information about our courses or related information.
  2. Dutch Acupuncture Academy can provide data to third parties for the following reasons:
    1. To persons who are directly involved in the supervision of students, such as teachers, assistants and / or internship supervisors.
    2. To professional associations and / or accreditation bodies, such as CPION, NVA or Zhong.
  3. Students have the right to access and correct their personal data. Dutch Acupuncture Academy adheres to the Personal Data Protection Act (CBP). Students who no longer wish to receive information from the Dutch Acupuncture Academy can report this in writing.
  4. Dutch Acupuncture Academy uses cookies to keep track of visitor data. We do this to optimize the layout of our site and the digital learning environment and to increase the ease of use, such as when logging in. Accepting cookies can be disabled in the browser. Disabling cookies may limit the use of our website and services. Accepted cookies will be stored indefinitely on the student’s computer.

Article 14 – Changes to the General Terms and Conditions

Unless otherwise agreed in writing, the general terms and conditions can be applied by the Dutch Acupuncture Academy
